Terms and Conditions

TERMS & CONDITIONS OF BOOKING AND TRAVEL

1. GENERAL

This quote is based upon aircraft and crew availability and is valid for 3 days. Flights may be operated by Capital Air Express FAA Part 135 Certificate 3C5A096S or Outer Banks Air Charters FAA Part 135 Certificate 06BA902L, each the "Operator." Upon acceptance, these terms become a legal and binding contract between the "Client" and the Operator; any modification without the Operator's written approval is prohibited. The Operator retains operational control, and the Pilot in Command has final authority to delay, divert, or cancel any flight or refuse boarding.

2. AIRCRAFT ASSIGNMENT AND AVAILABILITY

All flights are subject to aircraft and crew availability. The Client books the aircraft type quoted, not a specific aircraft: no specific aircraft, tail number, or crew member is guaranteed regardless of request or prior use, and the Operator may substitute a comparable aircraft without refund or credit. Requested times must fit within FAA crew duty limits and the operating hours of the airports, FBOs, and customs facilities involved; the Operator may adjust or decline times that cannot be accommodated.

3. PRICES, PAYMENT AND ADDITIONAL CHARGES

Prices are subject to change without notice until confirmed. Full payment is required at booking, and all payments for airfare are non-refundable in accordance with DOT 14 CFR Part 260. The Client authorizes all charges under these terms and acknowledges that the non-refundable and cancellation terms were accepted before payment. The Client agrees to contact the Operator before disputing any charge. A dispute of a valid charge is a breach of this Agreement, and the Client remains responsible for the amount plus any chargeback fees and collection costs. Quotes are estimates based on preferred FBOs, routes, and distances; billing reflects the actual itinerary, including weather deviations and ATC routings. The following time charges apply and are cumulative: overnight stay required by requested times, itinerary length, or delays, 1 hour; crew change when a trip exceeds crew duty time and a replacement crew is available, 1 hour; same-day round trip with more than 4 hours between segments, 0.5 hour; Bahamas, 1 hour per landing, including inter-island landings; other international trips, 1 hour each way. Block time Clients have these charges deducted from their block; other Clients are billed at the quoted aircraft's hourly rate.

4. BLOCK TIME AGREEMENT

Block time is non-refundable, and aircraft availability is not guaranteed. Block time does not reserve a specific tail number. Each block agreement provides one aircraft at a time, trips booked by any authorized user under the same agreement may not overlap.

5. CANCELLATIONS, CHANGES AND NO-SHOWS

Cancellation fees are measured from the first aircraft movement: 25% within 36 hours, 50% within 24 hours, and 75% within 12 hours for individual retail trips. Block time Clients may instead be charged 1 hour for cancellations within 24 hours, at the Operator's discretion. Any remaining balance after fees is held as a non-refundable flight credit for a future flight, subject to availability and rates at rebooking within 12 months. Passengers not present within 30 minutes after scheduled departure are a "no-show," with no refund or credit, and additional charges may apply. Itinerary changes are subject to availability and price adjustment; changes within 24 hours may not be accommodated. Changes and cancellations must be emailed to booking@capitalairexpress.com.

6. WEATHER AND OPERATIONAL IMPACTS

Decisions to operate, delay, divert, or cancel for weather, ATC, TFRs, airport restrictions, or mechanical conditions rest solely with the Operator and Pilot in Command. If the Operator cancels before departure for weather, no cancellation fee applies and payments are held as credit or applied to the rescheduled trip (no block hours deducted). If the Client cancels for weather the Operator has deemed flyable, Section 5 applies. Weather delays may require an overnight or extended wait, and Section 3 charges apply. If a flight cannot reach its destination due to factors outside the crew's control, charges apply only to portions completed. The Operator is not liable for replacement transportation, lodging, or other ancillary expenses.

7. DOCUMENTATION AND MANIFEST

Photo identification may be required for each adult passenger at the discretion of the Pilot in Command or dispatch. Travel documents (passport, visa, etc.) are each passenger's responsibility. A completed manifest with all passenger and baggage weights is required 24 hours before the first scheduled aircraft movement or a delay may occur. Incorrect, invalid or expired documentation required for international travel may be result in trip cancellation. If actual weights differ from estimates, the trip may be cancelled with no refund or credit.

8. RESPONSIBILITY

The Operator's responsibility pertains only to the contracted flight, and its liability is limited to the amount paid for the trip. For contracted aircraft operated under another carrier's Part 135 certificate, the Client shall hold harmless and indemnify Capital Air Express LLC and Outer Banks Air Charters LLC against any and all losses. Claims are governed by the laws of the State of Georgia.

9. PROHIBITED ITEMS AND HAZARDOUS MATERIALS

Passengers must follow federal regulations and crew instructions. No smoking or vaping (14 CFR § 135.127). No person may threaten, intimidate, distract, or interfere with a crewmember (14 CFR § 135.120); violations are federal crimes punishable by fines and up to 20 years' imprisonment (49 U.S.C. §§ 46504, 46318). Intoxicated passengers will not be boarded (14 CFR § 135.121). Weapons require prior written approval, and hazardous materials are prohibited (49 U.S.C. § 46312; see www.tsa.gov/traveler-information/prohibited-items). The Operator may refuse transport to any passenger who poses a safety risk (49 U.S.C. § 44902). Any violation will result in the Client forfeiting all trip payments and any remaining block time balance, plus any resulting fines or expenses.

As the Client, I hereby accept these terms by signing the quote or block time agreement. I agree that the current terms posted at capitalairexpress.com apply to all future trips and that I have read and understand the FAQs posted on the website.
